A Registered User (Participant) is defined as an individual who has purchased access to educational materials and those granted access by the Discloser (Ultrasound Registry Review, LLC or URR) who has received a Username and Password for access to materials.
In order to protect certain confidential information that may be disclosed by Discloser to the "Participant" above, they agree that:
The confidential information disclosed under this Agreement is described as:
A. All information related to the structure, formatting, content, development and expansion of the Discloser's educational materials accessed.
B. All communications between the Participant and the Discloser.
The Participant shall use the confidential information received under this Agreement for the purpose of:
A. Personal preparation for the ARDMS® and CCI® Registry Examinations in Sonography
The Participant shall protect the disclosed confidential information by using the same degree of care, but no less than a reasonable degree of care, to prevent the unauthorized use, dissemination, or publication of the confidential information. No group display, distribution or derivative works created from the use of the materials are permitted in accordance with federal copyright laws.
The Participant is responsible for maintaining their log in information (username, password) as confidential. Any Participant found to be distributing their log in information to others for access to the site will be found in violation of this confidentiality agreement and copyright law. Account access will be immediately removed and no refund will be provided if any Participant is found in violation of this agreement.
The Participant shall also agree to have no involvement personally with archiving, copying and/or distribution of the Discloser's confidential information listed above.
The Participant shall have a duty to protect only that confidential information which is (a) disclosed by Discloser in writing and marked as confidential at the time of disclosure, or which is (b) disclosed by Discloser in any other manner and is identified as confidential at the time of the disclosure.
All content displayed on the pages in the site www.ultrasoundregistryreview.com is considered confidential, except the images labeled with Creative Commons licensing.
This Agreement imposes no obligation upon the Participant with respect to confidential information that becomes a matter of public knowledge through no fault of the Participant. The Participant does not acquire intellectual property rights under this Agreement except the limited right of use set out in paragraph 4 above.
Discloser makes no representation or warranty that any product or business plans disclosed to the Participant will be marketed or carried out as disclosed, or at all. Any actions taken by the Participant in response to the disclosure of confidential information by Discloser shall be solely at its risk.
The Participant acknowledges and agrees that the confidential information is provided on an AS IS basis.
DISCLOSER MAKES NO WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO THE CONFIDENTIAL INFORMATION AND HEREBY EXPRESSLY DISCLAIMS ANY AND ALL IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. IN NO EVENT SHALL DISCLOSER BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, OR CONSEQUENTIAL DAMAGES IN CONNECTION WITH OR ARISING OUT OF THE PERFORMANCE OR USE OF ANY PORTION OF THE CONFIDENTIAL INFORMATION.
Upon DISCLOSER's written request, the Participant shall return to DISCLOSER or destroy all written material or electronic media and the Participant shall deliver to DISCLOSER a written statement signed by the Participant certifying same within 5 days. The parties do not intend that any agency or partnership relationship be created between them by this Agreement.
We do not and will not under any circumstances disclose, rent, share or sell any of the information we collect from Registered Users of URR materials.
The information we collect on this site is only used solely for the purposes stated below:
URR will collect contact and payment information from new or existing customers when they register for a subscription to the materials on the site. This is necessary so we can email the users a username and password information for website access.
URR will collect contact information from new or existing customers who choose to fill out our "Contact Us Form" or to communicate with Technical Support staff. We need this information to reply to their questions/comments/concerns.
All additions or modifications to this Agreement must be made in writing and must be signed by both parties.
This Agreement is made under and shall be construed according to the laws of the State of North Carolina.
